These Terms of Service apply to your use of niftynab.com and courier and delivery services offered by The Feathered Forge d/b/a Nifty Nab ("NiftyNab," "we," "us," or "our"). By using the website or requesting service, you agree to these terms.
Service requests and confirmation
Submitting a request through the website, by phone, or by text does not guarantee service. Each request is subject to our confirmation and availability. A delivery is accepted only after we confirm the relevant details with you.
Timing
Pickup and delivery times are estimates unless we separately agree in writing to a specific commitment. Traffic, weather, access delays, incorrect information, and other circumstances may affect timing. We will communicate with you when we become aware of a material delay.
Your responsibilities
You are responsible for:
- providing accurate pickup, delivery, contact, timing, and item information;
- ensuring someone is available when required for pickup or delivery;
- providing lawful, safe, and appropriately packaged items; and
- telling us about handling needs or restrictions before we accept the job.
Items we may refuse
We may refuse or stop a delivery involving an item that is illegal, unsafe, improperly packaged, inaccurately described, beyond our ability to handle, or otherwise unsuitable for the requested service. Acceptance of one delivery does not require us to accept another.
Pricing and payment
Pricing and payment terms may be quoted or agreed for an individual job, recurring route, or customer relationship. You agree to pay the charges you approve, together with any changes you authorize during the service.
Changes and cancellations
Requests to change or cancel a delivery are handled case by case unless we have separately agreed to specific terms. Contact us as soon as possible. Charges may apply when work has begun, a driver has been dispatched, or costs have already been incurred.
Limitation of liability
To the extent permitted by law, NiftyNab is not responsible for indirect, incidental, special, or consequential losses arising from use of the website or a delivery service. Any responsibility for direct loss will be determined under applicable law and any written terms separately agreed for the service. Nothing in these terms limits liability that cannot legally be limited.
Website and brand use
The website content, NiftyNab name, logo, and other branding may not be copied, modified, distributed, or used to suggest endorsement or affiliation without our permission. You may use the website only for lawful purposes and may not interfere with its operation or security.
Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
Changes to these terms
We may update these terms from time to time. The effective date at the top of this page shows when they were last updated. Continued use of the website or services after an update means the revised terms apply going forward.
